Referral Terms and Conditions

For a Kibo user (or “Referrer”) to receive the referral reward stated in the user's account and for each new customer (each a “referral” or “Referee”) to receive the promotional offer, each new customer (“Referee”) must use the Referrer-provided promo code by the expiration date indicated in the Referrer’s account; after the order using the Referrer-provided promo code is fulfilled, the Referrer will receive the reward for each such redemption.

Limit 1 referral promo code redemption per Referee. Code may only be used in one order for an order of $25 or more. Code cannot be used retroactively for prior purchases. Discount will be applied to the total purchase price excluding fees, taxes, delivery, or gratuities. In order to take advantage of this offer, customers must have a valid account on Kiboexprss.me, Referee must be cleared and deemed in good standing, not having duplicate emails, accounts, and should be a first-time customer.

Kibo reserves the right to modify or cancel this offer at any time. Referrals cannot be made to members of the same household or related user accounts. Code may not be sold, copied, modified, or transferred. Void where restricted or prohibited by law. Code has no cash value and cannot be redeemed for cash. Code cannot be used for Referrer's personal purchases and cannot be used more than once by the Referee. Kibo reserves the right to seek the return of such awards as a result of the violative behavior, including but not limited to deducting award points from the customers account, or charging the customers card on file to remedy the sum of the violative action. Nothing in this agreement constitutes an offer for employment, or contract for employment. Kibo may not be available in all zip or post codes.

1. Compliance

In connection with your participation in the Referral Program, you acknowledge and agree to all of the restrictions listed below.

​

1.1. No spam - You agree that you will not “spam” anyone, or the general public, with Referrals to join Kibo either by mass emailing, purchase or place advertisements, use of automated systems, bots or automatic dialers, and to not post Referral links on websites or event or venue pages without express consent from the owner. You agree to not engage in any device or scheme that results in “spam.”

1.2. No misrepresentations - You agree that you will not attempt to mislead anyone in connection with the Referral Program. This includes, but is not limited to, creating fake accounts, profiles, links or messages. You also agree that you will not use the personal information of any person in order to open an account in that person’s name. Further, you are expressly prohibited from implying any personal connection with Kibo, other than as a customer.

1.3. No kickbacks or incentives - You agree that you will not personally offer any incentives, monetary or otherwise, to Referred Customers in return for their participation in the program.

1.4. No modifications - You agree that you will not attempt to modify or obscure your referral link. This includes, but is not limited to, creating advertisements, hyperlinks, or otherwise publishing your referral link in a manner that is not in the exact format Kibo provides.

1.5. No prohibited content - You agree that you will not use any defamatory, offensive, abusive or obscene content in connection with Kibo. This includes, but is not limited to, content that violates someone else’s privacy or harassing content.

1.6. No fraudulent activity - You agree not to defraud or abuse, or attempt to defraud or abuse, or engage in deceptive or manipulative practices toward Kibo or any other business or individual in connection with the Referral Program. You agree not to engage in any activity that Kibo deems to be fraud or abuse, or any attempt to defraud or abuse, or to engage in deceptive or manipulative practices toward Kibo or any other business or individual in connection with the Referral Program.

1.7. No misuse of Kibo's content - Kibo's provision of the referral link to you does not grant you a license to use any other Kibo materials or intellectual property.  You agree not to sell Kibo's Referral links or create websites, email addresses or social media with Kibo's name, images or content without Kibo's express written consent. Kibo's content is not intended for distribution to, or use by, any person or entity in any jurisdiction where such distribution or use would be contrary to law or regulation or which would subject Kibo or any of Kibo's products or services to any authorization, registration, licensing or notification requirements within any jurisdictions outside those jurisdictions in which Kibo and its affiliates are licensed to operate.

Your compliance with the above restrictions, at all times, is required to participate in and benefit from the Referral Program. Kibo reserves the right to terminate or suspend your participation in the Referral Program or receipt of rewards from the Referral Program in the event that Kibo makes the determination that you violated any of these restrictions. Further, in the event that Kibo determines that you violated the terms of this Agreement, Kibo reserves the right to seek the return of any Rewards credited as the result of the violative behavior.
